City Attorney

West Melbourne, Florida

THE COMMUNITY AND LOCATION

The City of West Melbourne is minutes from the Florida's Atlantic Coast beaches and Cape Canaveral. Orlando International Airport and Orlando Sanford International are within a 90 minute drive. Jacksonville is three hours to the north and Miami three hours to the south. The community is pleasant, mostly residential, has a sense of community and is characterized by friendly people. Originally a retirement community, the demographics have shifted so that the population is younger and more professional. It is a middle income community with excellent schools and a great place to raise a family. Housing prices and the cost of living are both quite reasonable.

Incorporated in 1959, West Melbourne covers 10 square miles and a population of 15,000. Another 5,000 units are in the planning stages and a great deal of undeveloped land lies to the west. Once the construction industry recovers, West Melbourne is positioned for dramatic growth. Both its geographic limits and population could easily double in the next ten to fifteen years. The one thing missing is a downtown -- the City hopes that one of the upcoming development projects will resolve that issue.

THE GOVERNMENT

The City follows the Council-Manager form of government with a Mayor and six Council Members. The Mayor serves a three year term while the Council Members serve staggered two year terms and are elected at large. Its members sincerely want the best for their community and generally get along well. They view their current positions not a stepping stone but an opportunity to give back to the community. Relationships among them have improved since the November election and they are currently involved in goal setting for the City. The departure of the last City Attorney was somewhat divisive but we believe that the elected officials are sincerely interested in operating more collegially in the future. Overall, the Council is mildly pro-development but also concerned about the environment and energy efficiency. The government has been fiscally conservative historically and property taxes were only introduced three years ago.

The City government is lean and well run. It has only 110 employees. The total budget is $39 million and the general fund budget is $14 million. With the recent property tax reform in Florida, some belt tightening is anticipated. The City provides almost all the standard city services (police, growth management, parks and recreation, water distribution, wastewater and stormwater). Water is purchased from neighboring Melbourne and Fire is provided by the County. The City has begun planning for construction of its own water treatment facility and a second wastewater treatment plant.

THE ISSUES

West Melbourne's issues are challenging but manageable. These include:

Finances. With the passage of the property tax reform amendment in January, some belt tightening is anticipated.

Annexation and Development. A significant amount of unincorporated land lies to the west of the City. Ideally, it will become part of the City and appropriate development will occur.

Utilities. West Melbourne is under contract to purchase water from Melbourne for the next 20 years but is not pleased with the service. The City is in the midst of upgrading some of its distribution infrastructure.

THE IDEAL CANDIDATE

West Melbourne is looking for an experienced City Attorney. The individual will be well rounded and have experience with contracts, environmental matters, land use, utilities and labor/personnel issues. He/she will be apolitical, accessible, responsive, appropriately creative, upbeat and positive. The individual will also have a "can do" attitude and be a team player. A high degree of integrity and ethics is essential. He/she will be a member of the Florida bar and the U.S. District Court for the Middle District of Florida. At least five years experience as a City Attorney or Deputy City Attorney is required.

COMPENSATION

The starting salary will be between $100,000 and $140,000. The City prefers to pay in the lower half of the range but recognizes that getting the right person may require a higher salary.

As you know, our firm does temporary staffing for specialized professionals in advertising, marketing and public relations. We have a critical need for qualified bilingual (Spanish-English) writers and translators. The clients who need these services usually request them on a sporadic project basis. One, however, may have the need for a full time contractor (30-40 hours per week) soon.

In all cases, the contractor must work on site in the client's offices during traditional working hours (9 am to 5 pm). Pay is quite good. Usually in the $35 to $55 per hour range.
